La urgent necessitat de regular el fenomen del lobbisme no pot dur-nos a la importació irreflexiva de models aliens al nostre marc constitucional i a l'evolució que els drets de participació política han experimentat en els últims anys. La gradual incorporació al «bloc de la constitucionalitat» de nous catàlegs de drets mitjançant la seva codificació en els estatuts d'autonomia de «tercera generació», suposa un punt d'inflexió en la restrictiva consideració que el Tribunal Constitucional ha vingut elaborant sobre el dret a la participació política. Malgrat les contínues recomanacions dels organismes internacionals perquè la regulació dels grups d'interès es duga a terme amb respecte als drets i llibertats constitucionals de cada estat, les incipients regulacions nacionals sobre aquesta matèria semblen no fer cas a aquests consells. Com a resultat, les normes espanyoles sobre grups d'interès no estan considerant adequadament aspectes essencials d'aquesta regulació, com és la identificació de què és lobbisme i qui ha de considerar com un lobbista. Tampoc no s'està encertant sobre quin tipus de sancions s'han d'imposar o mitjançant quins instruments normatius ha de realitzar-se aquesta regulació. Tot això sotmet a les noves normes que es dicten a evidents riscos d'inconstitucionalitat. ; The urgent need to regulate the phenomenon of lobbying cannot lead us to the thoughtless importation of models outside our constitutional framework and the evolution that the right of political participation have experienced in recent years. The gradual incorporation into the «block of the constitutionality» of new catalogs of rights through its codification in the statutes of autonomy of the «third generation», represents a turning point in the restrictive consideration that the Constitutional Court has been elaborating on the right to political participation.
