| Description: | The article examines the legal mechanism for competitive selection of the Head of the State Customs Service of Ukraine, which was in place until 31 October 2024, and the innovations introduced by the Law of Ukraine No. 3977-IX dated 17 September 2024. In addition, a comparative legal analysis of the updated mechanism with the procedure for conducting competitions for the positions of heads of the National Anti-Corruption Bureau of Ukraine, the National Agency for the Prevention of Corruption, the Bureau of Economic Security of Ukraine and the Specialised Anti-Corruption Prosecutor’s Office is carried out. Special attention is also paid to analysing the procedure for competitive selection of heads of customs authorities in the USA, France and Germany.The authors state that by updating the procedure for forming the composition of the competition commission for the selection of the Head of the State Customs Service of Ukraine and providing for the need to include representatives of international and foreign organisations, which, by international or interstate agreements, provided Ukraine with international technical assistance in the areas of structural reforms, financial and technical support, and prevention and counteraction to corruption, on the one hand, the national legislator has unified it with the relevant procedures for competitive selection of heads of other law enforcement agencies. On the other hand, it has fulfilled its obligations to Ukraine’s international partners. У статті досліджено правовий механізм конкурсного відбору Голови Державної митної служби України, який функціонував до 31 жовтня 2024 року та новації, запроваджені унаслідок прийняття Закону України від 17 вересня 2024 року № 3977-IX. Окрім того, здійснено порівняльно-правовий аналіз оновленого механізму із порядком проведення конкурсів на посади керівників Національного антикорупційного бюро України, Національного агентства з питань запобігання корупції, Бюро економічної безпеки України та Спеціалізованої антикорупційної прокуратури. Також окрему увагу приділено аналізу процедури конкурсного відбору керівників митних органів США, Франції та Німеччини.Констатується, що оновивши процедуру формування складу конкурсної комісії з відбору Голови Державної митної служби України та передбачивши необхідність включення до її складу представників міжнародних та іноземних організацій, які відповідно до міжнародних або міждержавних угод надавали Україні міжнародну технічну допомогу у сферах проведення структурних реформ, фінансової та технічної підтримки, запобігання і протидії корупції, з одного боку, вітчизняний законодавець уніфікував її із відповідними процедурами конкурсного відбору керівників інших правоохоронних органів, а з іншого – виконав узяті на себе зобов’язання перед міжнародними партнерами України. |
