Рассмотрены юридические факты, необходимые для прекращения трудового договора с работником в связи с направлением в лечебно-трудовой профилакторий по решению суда в соответствии с Трудовым кодексом Республики Беларусь. Основная мысль статьи заключается в том, что прекращения трудового договора по данному основанию относится к обстоятельствам, не зависящим от воли сторон трудового договора. Также обращено внимание на то, что данное основание увольнения требует выполнения определенных условий, установленных законодательством. Предложена редакция статьи Трудового кодекса, чтобы исключить несогласованность правовых норм, регулирующих прекращение трудового договора. The article examines the legal facts that are necessary for terminating an employment contract with an employee due to their placement in a medical and labor rehabilitation dispensary by a court decision in accordance with the Labor Code of the Republic of Belarus. The main idea of the article is that the termination of an employment contract on this basis is considered to be circumstances beyond the control of the parties to the employment contract. The author also emphasizes that this ground for dismissal requires the fulfillment of certain conditions established by legislation. In conclusion, the author proposes an amendment to the article of the Labor Code to eliminate inconsistencies in the legal norms regulating the termination of an employment contract. |
