| Περιγραφή: | The article deals with the issues of increasing the effectiveness of crime investigation methods, their separate types and groups. Having summarized some criminalists' viewpoints, the author thinks about modern national criminalistics and the problem of its adaptation to the processes of modernization of our legal system. He believes that scientific provisions and recommendations being developed within the framework of this science must contain the typical arguments for the adoption of intermediate and final decisions in criminal cases; they should represent a constantly supplemented complex of criminalistics algorithms and programs which will serve a basis for the formation of an optimized technology for both pretrial and court proceedings in this or that criminal case. The author is aware that to solve the above problems is not an easy thing. It is necessary to move to a qualitatively new level of knowledge that implies a stage by stage purposeful renewal of criminalistics and elimination of illusions and dogmata in it. Both the theoretical basis and the very practice of legitimate and effective usage of the achievements of our criminalistics should be different. Nevertheless, despite evident difficulties, its potential is so high that it enables us to solve the problems connected with the renewal of its private theories, branches and sections taken as a whole. Criminalistics methods need it more than others: nowadays they are ineffective theoretical methods deprived of the characteristics of mass nature, determinacy and effectiveness. The main reason for this is that the subjects of investigation cannot use valuable information contained in criminalistics recommendations. Thus, there is an urgent demand for the development of recommendations which will enable both investigators and inquiring officers to operate consistently and according to the prearranged schemes. The application of criminalistics algorithms or investigation programs in this case will help to concentrate attention on all the major directions of forthcoming activities and ensure a real intellectual support for the solution of the preliminary investigation tasks. For all this to become true, each private methodology should be changed, simplified and presented as a set of criminalistics algorithms and investigation programs. Using the contained data and acting as recommended, both investigators and inquiring officers can find the optimal ways for transforming the original data about an investigative situation into the sought results. В статье рассматриваются вопросы повышения эффективности методик расследования преступлений, отдельных видов и групп. Обобщив точки зрения криминалистов, автор стремится доказать, что разрабатываемые в рамках криминалистической методики научные положения и практические рекомендации должны иметь все необходимое для реального применения в деле защиты прав и законных интересов потерпевших от преступлений, а также личности от незаконного обвинения, осуждения, ограничения ее прав и свобод. Они должны содержать типичные аргументы для принятия промежуточных и итоговых решений по уголовным делам, представляя собой постоянно пополняемый комплекс криминалистических алгоритмов и программ, из которых должна формироваться оптимальная технология досудебного и судебного производства по тому или иному уголовному делу. |
