| Περιγραφή: | As a result of the historical events that occurred in the Crimea Peninsula since March 21, 2014, Russia included two new subjects: the Republic of Crimea and the federal city of Sevastopol. By legislation March 21, 2014 to January 01, 2015 is the transition period during which questions are to be regulated of the integration of the new RF subjects into the economic, financial, credit, legal and state authority systems of the RF. Establishments of the State Penitentiary Service of Ukraine (USPS) located in the territories of the new RF subjects are also to be integrated into the Russian correctional system. In order to establish the corresponding integration mechanism the leadership of the country, the Justice Department of Russia, the Federal Penitentiary Service of Russia have developed and are implementing a complex of organizational-legal measures. The carried out analysis of the organizational-legal measures for integration made it possible to single out the measures of organizational and legal nature. Organizational integration measures are visits by the leadership of the organs of justice of the establishments of USPS located in the territories of the new RF subjects for the acquaintance with the organization of the USPS activity in the peninsula, estimation of its state etc.; development of the plan of organization and staffing measures for establishing the Federal Penitentiary Service of Russia territorial body and institutions subordinate to it in the new RF subjects; development of projects of subordinate legislation and others. Legal measures for integration include measures for the publication of the following group of subordinate legislation: 1) RF Presidential Decrees (for example, on the regulation of hiring of the citizens of Russia for the correctional system establishments in the Republic of Crimea and Sevastopol); 2) orders of government (for example, the establishment of the maximum of staff in the of convoying division); 3) orders of the Federal Penitentiary Service of Russia (in particular, the approval of the Regulation on the Federal Penitentiary Service Department in the Republic of Crimea and Sevastopol). The complex of organizational-legal measures for integration consisted of preparation and realization of measures in the correctional system activities. They were: organization of the activity of the correctional system in the new region; regulation of hiring of the citizens of Russia for the correctional system establishments in the new RF subjects; providing social safeguards to separate categories of citizens serving in the territories of the new RF subjects; pension guarantee for the transition period. The integration of the establishments of USPS located in the territories of the new RF subjects is an important and complex problem which does not have precedents in the newest history of Russia. It is possible to solve this problem only by joint efforts of the leadership of the country and correctional system, by realizing the indicated measures of organizational-legal nature. Исследован комплекс организационно-правовых мер, направленных на интеграцию расположенных на территориях Республики Крым и города федерального значения Севастополя учреждений Государственной пенитенциарной службы Украины в российскую уголовно-исполнительную систему. Совокупность рассматриваемых мер проанализирована как соответствующий механизм по реализации интеграции с их дифференциацией на мероприятия организационного и правового характера, а также исследованы итоги по ее реализации. |
