На основе системного анализа правовых норм, устанавливающих режим деятельности самозанятых физических лиц, с учетом субъектного критерия исследованы договорные обязательства с участием самозанятых лиц, не обладающих статусом индивидуальных предпринимателей: с гражданами-потребителями, субъектами предпринимательской деятельности, отдельными видами юридических лиц (в публичных и корпоративных закупках). Показано, что статус самозанятых лиц неоднозначен, в связи с чем возникают риски для контрагентов самозанятых лиц и сложности реализации мер ответственности. Выявлены особенности и проблемы данных договорных обязательств, предложены пути их решения. On the basis of a systematic analysis of legal norms establishing the mode of activity of self-employed individuals, taking into account the subjective criterion, contractual obligations with the participation of self-employed individuals who do not have the status of individual entrepreneurs are investigated: with consumer citizens, business entities, certain types of legal entities (in public and corporate procurement). It is shown that the status of self-employed individuals is ambiguous, in connection with which there are risks for contractors of self-employed individuals and difficulties in implementing liability measures. The features and problems of these contractual obligations are revealed, the ways of their solution are proposed. |
