| Description: | Κεντρικά ζητήματα της παρούσας εργασίας αποτελούν η έννοια του λήπτη της ασφάλισης/ασφαλισμένου ως ειδικότερη περίπτωση καταναλωτή, η διάκριση ανάμεσα στους γενικούς και στους ειδικούς όρους ασφάλισης, η σχέση του νόμου για την προστασία του καταναλωτή (ν. 2251/1994) με τον ΑσφΝ (ν. 2496/1997), αναφορικά με την ένταξη, την ερμηνεία και τον έλεγχο των Γενικών Όρων Ασφάλισης, καθώς και η ειδικότερη κατηγορία των ρητρών μονομερούς αναπροσαρμογής του ασφαλίστρου και η αντιμετώπισή τους από την νομολογία και τη θεωρία πριν από την εισαγωγή του νέου άρθρου 2Α ν. 2251/1994, ενώ η εργασία ολοκληρώνεται με ανάλυση και συνολική αξιολόγηση του νέου αυτού άρθρου Central issues are the concept of the policyholder/insured as a consumer, the distinction between general and special insurance conditions, the relation between the Consumer Protection Law (Law 2251/1994) and the Insurance Law ( Law 2496/1997), regarding the inclusion, interpretation and control of the General Insurance Conditions, as well as the specific category of price adjustment clauses in insurance contracts and their treatment by jurisprudence and theory before the introduction of the new article 2A Law 2251/1994, while the thesis concludes with an analysis and overall evaluation of this new article. |
