Несмотря на то, что уголовно-процессуальный закон не предусматривает возможность использования гипноза при раскрытии и расследовании преступлений, он используется в ходе досудебного производства. В статье рассматривается вопрос о процессуальном оформлении результатов привлечения гипнолога в ходе расследования преступления. Приводятся положительные примеры использования гипноза в раскрытии преступления. При этом, автор приводит противоречивые способы оформления результатов использования гипноза. В ходе анализа всех возможных доказательств автор приходит к выводу, что результаты использования гипноза в уголовном процессе должны оформляться заключением психофизиологической судебной экспертизы и ни в коем случае допросом. Although Criminal Procedural Law does not provide for the use of hypnosis in the course of detection and investigation of crimes it has been used in pretrial proceedings. The article examines the matter of procedural registration of the results of the hypnologist activity in the course of crime investigation and presents good practices of the use of hypnosis in crimes detection. However the author presents quite controversial ways of processing and registration of the results whereof. While analyzing all possible relevant evidences the author comes to the conclusion that the results of the use of hypnosis in criminal proceedings should be arranged through psycho-physiological judicial examination and in way through the interrogation. |
