Рассматриваются вопросы о субъектах собирания и проверки доказательств в уголовном судопроизводстве. Высказывается мнение, что в ст. 86 действующего уголовно-процессуального закона необоснованно наделены правом собирания доказательств в виде письменных документов и предметов подозреваемый, обвиняемый, а также потерпевший, гражданский истец, гражданский ответчик и их представители. Собирание доказательств, с точки зрения автора, может осуществляться лишь теми участниками уголовного процесса, в производстве которых находится уголовное дело. Исключением из этого правила является защитник. Issues on the subjects of collecting and verifying evidence in criminal proceedings are considered. It is suggested that in Art. 86 of the current criminal procedure law the suspect, the accused, as well as the victim, civil plaintiff, civil defendant and their representatives are unreasonably vested with the right to collect evidence in the form of written documents and objects. The collection of evidence from the point of view of the author is carried out only by those participants in the criminal process who take part in the production of the criminal case. An exception to this rule is the trial lawyer. |
