| Περιγραφή: | Розкривається сутність та зміст оперативно-розшукової ситуації як елемента структури оперативно-розшукової тактики. З’ясовано, що у формуванні оперативно-розшукової ситуації як елемента оперативно-розшукової тактики провідну роль відведено слідчій ситуації. Надано авторське формулювання поняття "оперативно-розшукова ситуація" як сукупність об’єктивних та суб’єктивних чинників, що впливають на ефективність здійснення оперативно-розшукової діяльності у певних просторово-часових межах. Виокремлено об’єктивні та суб’єктивні чинники, що впливають на формування оперативно-розшукової ситуації. Зроблено висновок, що важливим для підвищення ефективності протидії злочинності є розроблення алгоритмів необхідних дій працівників оперативних підрозділів у типових оперативно-розшукових ситуаціях, про що зазначило 89 % опитаних. Раскрывается сущность и содержание оперативно-розыскной ситуации как элемента структуры оперативно-розыскной тактики. Установлено, что в формировании оперативно-розыскной ситуации как элемента оперативно-розыскной тактики ведущая роль отведена следственной ситуации. Представлена авторская формулировка понятия "оперативно-розыскная ситуация" как совокупность объективных и субъективных факторов, влияющих на эффективность осуществления оперативно-розыскной деятельности в определенных пространственно-временных пределах. Выделены объективные и субъективные факторы, влияющие на формирование оперативно-розыскной ситуации. Сделан вывод, что важной для повышения эффективности противодействия преступности является разработка алгоритмов необходимых действий работников оперативных подразделений в типичных оперативно-розыскных ситуациях, о чем отметили 89 % опрошенных. The article reveals the subject matter and content of the operational and search situation as an element of the structure of the operational and search tactics. It has been established that in the formation of the operational and search situation as an element of the operational and search tactics, the leading role is devoted to the investigative situation. At the same time, it is emphasized that despite some common components, the operational and search situation, unlike the investigative one, is the subject of study of operational and search activity, effective implementation of which, above all, involves the proper organization of covert actions. The genesis of the formation of the operational and search situation in the theory of operation and search activity is highlighted, in particular, it is noted that the achievements of Soviet scientists served as the theoretical basis for further scientific research on the subject matter. While analyzing the main definitions of the term "operational and search situation", our own definition relating to the scope of the research was given. Operational and search situation is a combination of objective and subjective factors affecting the effectiveness of the implementation of operational and searches activity within certain space-time limits. The objective and subjective factors influencing the formation of the operational and search situation are highlighted. It was noted that the subject of operational and search activity for proper assessment of operational and search activity should acquire such personal qualities as: rational thinking (aimed at making considered decisions); intellectual work; the ability to choose in a particular situation the necessary course of actions in order to accomplish the tasks of the operational and search activity; knowledge of the legislative and regulatory framework that allows the operational worker to apply the acquired special knowledge and legal skills, etc. The analysis of the main scientific approaches to the elements and types of operational and search situation, on the basis of which provided its own vision of its elements to be a priority assessment was carried out, as well as classification of operational and search situations, taking into account changes in domestic legislation. It was concluded that the development of algorithms for the necessary actions of employees of operational units in typical operative and search situations is important for increasing the effectiveness of the counteraction to crime, as noted by 89 % of respondents. |
