| Description: | The article is devoted to problems of action of provisions of the Resolution of the Plenum of the Supreme court of the Russian Federation from 22.12.2015 “On the practice of appointing by Russian courts a criminal punishment” in time and particulary to questions of the reverse force of this position. The authors of the article pay attention to the difficulties, faced by law enforcement officials about deciding on the inverse force of the decisions of the Plenum. It is concluded that states of the Resolution of the Plenum of the Supreme Court of the Russian Federation from 22.12.2015 № 58 do not have the inverse force to acts committed before its adoption. Статья посвящена проблемам действия положений Постановления Пленума Верховного Суда РФ от 22 декабря 2015 г. № 58 «О практике назначения судами РФ уголовного наказания» во времени, и в частности вопросам обратной силы действия этого постановления. Авторы статьи обращают внимание на трудности, с которыми сталкиваются правоприменители при решении вопроса об обратной силе постановлений Пленума. Сделан вывод о том, что положения Постановления Пленума Верховного Суда РФ от 22 декабря 2015 г. № 58 не имеют обратной силы в отношении деяний, совершённых до его принятия. №1(54) (2018) |
