В статье обозначена проблема осуществления основных прав и свобод в связи с их реализацией посредством современных сетевых ресурсов в новой цифровой системе отношений — такие права условно можно именовать цифровыми. Специальное внимание уделено соотношению содержания и порядка реализации этих прав и основных прав в их классическом выражении. В центре внимания новые права, такие как право на забвение, право на анонимность, право на защиту персональных данных, а также проблема допустимого воздействия на статус субъектов сетевого общения в связи с выполнением функций обеспечения общественного порядка. The article identifies the problem of the enforcement of fundamental rights and freedoms in connection with their realization through modern network resources in the new “digital” system of relations, such rights can be called digital rights. A special attention is paid to the correlation of the content and procedure of the implementation of these rights and fundamental rights in their classical terms. The spotlight is on such “new” rights as the right to be forgotten, the right to anonymity, the right to protection of personal data, as well as the problem of permissible impact on the status of subjects of network communication in connection with the functions of ensuring public order. |
