Автор статьи на основе анализа исторических документов и нормативных правовых актов приходит к выводу о том, что федеративные отношения в СССР строились по национально-территориальному принципу, обосновывая право каждой отдельной нации на собственную государственность: либо в виде союзного государства на договорной основе, либо в виде автономии с определенными принципами взаимоотношений с центральной властью. При этом исключительная компетенция СССР в плане принятия законодательства и руководства сферами правового регулирования может быть также отнесена и к фактической совместной компетенции между СССР и союзными республиками в его составе. Based on the analysis of historical records and normative legal acts the author of the article comes to the conclusion that federal relations in the USSR were built on the national and territorial principle, substantiating the right of each individual nation to its own statehood either in the form of a union state on a contractual basis or in the form of autonomy with certain principles of relations with the central government. At the same time the exclusive competence of the USSR in terms of adopting legislation and managing the spheres of legal regulation can also be attributed to the actual joint competence between the USSR and the union republics within it. |
