| Description: | This article substantiates the opinion that the general rules for the conduct of investigative actions enshrined in Article 164 of the Criminal Procedure Code of the Russian Federation (hereinafter referred to as the CPC) are not general, the application of which is possible in the conduct of all investigative actions without exception. The provisions of Article 164 of the CPC do not contribute to the optimal systematization of the rules of investigative actions, they are eclectic, duplicate other provisions of the law. The concepts similar at first glance, the general rules for the production of investigative actions and the general conditions for the production of investigative actions are distinguished. A list of general conditions that ensure the possibility of each investigative action is provided. В статье обосновывается мнение, согласно которому закрепленные в ст. 164 Уголовно-процессуального кодекса Российской Федерации общие правила производства следственных действий не являются общими, применение которых возможно при производстве всех без исключения следственных действиях. Положения статьи 164 УПК РФ не способствуют оптимальной систематизации правил производства следственных действий, они эклектичны, дублируют другие положения закона. Разграничиваются схожие на первый взгляд понятия: «общие правила производства следственных действий» и «общие условия производства следственных действий». Приводится перечень общих условий, обеспечивающих возможность производства каждого следственного действия. |
