| Description: | В статье акцентируется внимание на актуальных для Российской Федерации проблемах защиты прав, свобод и законных интересов детей, подчеркивается важность всех составляющих правового статуса ребенка для его полноценного существования и развития. Авторы отмечают значимость международных нормативных правовых актов о правах ребенка для формирования национальных систем права. Отдельное внимание уделяется констатации начального момента, с которого следует считать правозащитный механизм в отношении детей действующим. Просчеты в функционировании данного механизма наглядно демонстрируются примерами из практики Европейского суда по правам человека. The article focuses on the problematic issues of protection of the rights, freedoms and legitimate interests of children relevant to the Russian Federation, emphasizes the importance of all components of the legal status of a child for its full existence and development. The authors note the importance of international normative legal acts on the rights of the child for the formation of national legal systems, special attention is paid to the establishment of the initial moment from which the human rights mechanism for children should be considered valid. The miscalculations in the functioning of this mechanism are clearly demonstrated by examples from the practice of the European Court of Human Rights. |
