| Description: | Рассматриваются место и роль депутата в системе государственных должностей. Изучение разных подходов к понятию должность позволило автору выявить парадигму дефиниции государственная должность , а также определить взаимосвязь депутата с публично-властными полномочиями органов государственной власти. В процессе исследования использованы диалектический, сравнительно-правовой и системно-структурный научные методы познания. Предмет активной дискуссии составляет порядок регламентации вопросов замещения государственных должностей в представительном органе власти. На основе системного анализа норм законодательства и существующей практики, определяющих статус депутатов, автор выделил правовые признаки понятия депутата как лица, замещающего государственную должность в представительном органе власти, что позволит обеспечить единообразный подход к характеристике положения депутата в системе государственных должностей The article explores the place and role of the deputy in the system of public positions, which predeterminates its purpose and content. The study of different approaches to the concept of office revealed the paradigm of defining the concept of public office, to determine the relationship between the deputy and the public authority of the state authorities. Dialectical, comparative-legal and systemic-structural scientific methods of knowledge were used in the research process. The subject of active discussion is the procedure for regulating the replacement of public positions in a representative authority. On the basis of a systematic analysis of the legislation and existing practice defining the status of deputies, the author highlighted the legal characteristics of the concept of a deputy as a person in a public office in a representative authority, which would ensure a uniform approach to characterizing the position of a deputy in the system of public office. |
