Description:	В статье рассматриваются отдельные вопросы правового регулирования охраны и использования водных биологических ресурсов как объекта природных ресурсов, животного мира. Автор анализирует текущее положение в сфере борьбы с браконьерским промыслом водных биологических ресурсов, действующие правовые нормы и правоприменительную практику. В исследовании обосновывается мнение о возможностях развития института юридической ответственности за незаконный промысел водных биологических ресурсов. Авторские предложения разработаны на основе решения Совета по вопросам агропромышленного комплекса и природопользования при Совете Федерации ФС РФ от 15 ноября 2021 г. и личного практического опыта. Представляя водные биологические ресурсы в качестве объекта животного мира, автор предлагает меры усиления уголовной и административной ответственности за незаконную приемку, обработку, транспортировку, хранение и сбыт водных биоресурсов и продукции из них, а также конфискацию орудий лова, являющихся орудиями совершения правонарушения, не принадлежащих нарушителям на праве собственности. The article deals with certain issues of legal regulation of the protection and use of aquatic biological resources as an object of natural resources, wildlife. The author analyzes the current situation in the field of combating poaching of aquatic biological resources, the current legal norms and law enforcement practice. The study substantiates the opinion on the possibilities of developing the institution of legal liability for illegal fishing of aquatic biological resources. The author's proposals were developed on the basis of the decision of the Council on Agro-Industrial Complex and Environmental Management under the Federation Council of the Federal Assembly of the Russian Federation dated November 15, 2021 and personal practical experience. Representing aquatic biological resources as an object of the animal world, the author proposes measures to strengthen criminal and administrative liability for the illegal acceptance, processing, transportation, storage and sale of aquatic biological resources and products from them, as well as the confiscation of fishing gear that are tools for committing an offense that do not belong to violators on the right of ownership.
