| Description: | Исследование посвящено анализу российского законодательства в отношении регулирования права человека на тишину на разных исторических этапах. Утверждается, что государственная защита общественной тишины и спокойствия имела место как в период существования Российской империи, так и в советское время. Исторический опыт правового регулирования может быть использован при формировании современного механизма гарантирования права граждан на тишину и покой. Отмечается необходимость принятия федерального законодательства, регулирующего защиту прав граждан на тишину и покой. The study is devoted to the analysis of Russian legislation at different historical stages in relation to the regulation of the human right to silence. It is argued that the state protection of public peace and tranquility took place both during the existence of the Russian Empire and in Soviet times. The historical experience of legal regulation can be used in the formation of a modern mechanism for guaranteeing the right of citizens to peace and quiet. The necessity of adopting federal legislation regulating the protection of the rights of citizens to peace and quiet is noted. |
