| Περιγραφή: | Обосновывается необходимость развития требований Конституции РФ об имплементации норм Конвенции о защите прав человека и основных свобод в части несправедливо исследованных доказательств на примере решений Европейского cуда по правам человека; определяется понятие справедливости; обосновывается необходимость формирования Верховным Судом РФ практики единообразного исследования доказательств в суде. The necessity for development of the requirements of the Constitution of the Russian Federation on the implementation of the provisions of the Convention for the protection of human rights and fundamental freedoms in part of unjustly investigated evidence is justified by the example of the decisions of the European Court of human rights; the concept of justice is defined; the necessity of the formation of the practice of consistent research of evidence in court by the Supreme Court of the Russian Federation is substantiated. |
