| Description: | Cовременный научный дискурс практически не рассматривает причины, побуждающие государство, в лице законодателя использовать рецепцию права, в том числе и в полномасштабной ее форме, что связано с выделением ее единственной цели в виде улучшения действия национальной правовой системы. Однако, рецепция права не ограничивается лишь этой функцией. Законодатель использует рецепцию права при проведении правовых реформ и в таких случаях, как принятие идеологии или религии в качестве государственных, в рамках интеграционных процессов, при наличии угрозы национальному суверенитету либо его ограничения, уничтожения со стороны других стран. Modern scientific discourse practically does not consider the reasons that encourage the state, represented by the legislator, to use the reception of law, including in its full-scale form, which is associated with the allocation of its sole purpose in the form of improving the operation of the national legal system. However, the reception of the right is not limited only to this function. The legislator uses the reception of law when carrying out legal reforms and in such cases as the adoption of ideology or religion as a state, within the framework of integration processes, when there is a threat to national sovereignty or its restriction, destruction by other countries. |
