В статье проведён анализ отдельных аспектов правового регулирования «гонорара успеха» адвоката, его допустимость в договоре об оказании юридической помощи, а также определена правовая природа и содержание такого вознаграждения. Авторами на основе анализа материалов судебной практики выявлены основные проблемы правового регулирования отношений в сфере оказания юридических услуг адвоката как судебного представителя. The article provides analysis of certain aspects of legal regulation of a lawyer's «contingent fee», its admissibility in a legal assistance agreement, and also defines the legal nature and the content of such a remuneration. On the basis of the analysis of materials of judicial practice the authors identified the main problems of legal regulation of relations in the field of providing legal services by a lawyer as a legal representative. |
