| Description: | В рамках научной дискуссии рассматривается правовая природа частной детективной деятельности в контексте ее соответствия системообразующим элементам гражданского права. На основе анализа положений Закона Российской Федерации от 11 марта 1992 года № 2487-1 «О частной детективной и охранной деятельности в Российской Федерации» выявляются проблемы, обусловленные несогласованностью правовой природы и правового регулирования исследуемой деятельности с предметом, методом, принципами и источниками гражданского права. Предлагается решение выявленных проблем посредством разработки Федерального закона «О частной детективной деятельности в Российской Федерации». Within the framework of the scientific discussion, the legal nature of private detective activity is considered in the context of its compliance with the system-forming elements of civil law. Based on the analysis of the provisions of the Law of the Russian Federation No. 2487-1 of March 11, 1992 «On private detective and security activities in the Russian Federation», the problems caused by the inconsistency of the legal nature and legal regulation of the activity under study with the subject, method, principles and sources of civil law are identified. The solution of the identified problems is proposed through the development of the Federal Law «On Private Detective Activity in the Russian Federation». |
