| Description: | Формулируются критерии дифференциации злоупотребления должностными полномочиями от их превышения с учетом сравнительного исследования уголовных законов России и Казахстана и разъяснений Верховных судов этих государств. Утверждается, что действующий закон не дает оснований для отграничения злоупотребления от превышения в зависимости от наличия или отсутствия специальных мотива или цели, различия лежат в плоскости объективной стороны. Criteria for differentiation of abuse of power from their exceeding are formulated taking into account comparative research of criminal laws of Russia and Kazakhstan and explanations of the Supreme courts of these states. It is argued that current law does not provide grounds for distinction of abuse from exceeding depending on the presence or absence of a special motive or purpose, the differences centers around the objective side |
