В статье рассматривается эволюция критериев эффективности правового регулирования в российской юридической науке XVIII – начала XX века. Проанализированы работы российских теоретиков права, отраслевиков и международников дореволюционного периода. Показано, что сама идея эффективности правового регулирования зародилась в России в середине XVII века и была реализована в издании Соборного уложения 1649 года. В хронологическом порядке показано формирование критериев эффективности правового регулирования. The article considers the evolution of the criteria for the effectiveness of legal regulation in Russian legal science in the XVIII – early XX centuries. The work of Russian legal theorists, industrialists and internationalists of the pre-revolutionary period is analyzed. It is shown that the very idea of the effectiveness of legal regulation originated in Russia in the middle of the XVII century and was implemented in the publication of the Cathedral Code of 1649. The formation of criteria for the effectiveness of legal regulation is shown in chronological order. |
