Περιγραφή: ENG- The thesis examines tort law from a legal and philosophical perspective, interpreting it as a legal artifact whose architecture should considers its normative structure, functions, and the errors that may arise in its design and implementation. It argues that the purpose of tort law is to establish a just interpersonal normative framework and that its implementation within a legal system can be assessed through its functions and dysfunctions. Thus, it is emphasized that, as a matter of principle, the authorities, when designing and implementing the tort law, must ensure a balanced fulfillment of their functions, giving prima facie priority to the distinctive function, in alignment with the normative and social context. This work contributes to the theoretical and normative debate on tort law, particularly regarding its reform in response to emerging social dynamics
Description (Translated): CAT- La tesi analitza la responsabilitat civil extracontractual des d’una perspectiva jurídica i filosòfica, interpretant-la com un artefacte jurídic l’arquitectura del qual ha de tenir en compte la seva estructura normativa, funcions i els errors que poden sorgir en el seu disseny i implementació. Proposa que el propòsit de la RCE és establir un marc normatiu interpersonal just, i que la seva implementació en un ordenament jurídic es pot avaluar a través de les seves funcions i disfuncions. Així, es destaca que les autoritats, en dissenyar i implementar l'RCE, han de garantir, com a qüestió de principi, un compliment equilibrat de les seves funcions, atorgant una prioritat prima facie a la funció distintiva, en coherència amb el context normatiu i social. Aquest treball contribueix al debat teòric i normatiu sobre la RCE, especialment pel que fa a la seva reforma davant les dinàmiques socials emergents
