It involves a limited exercise of power. System based on the existence of a hierarchy of norms and on the independence of the judge, the rule of law currently remains the only legal and political means to protect fundamental rights and guarantee the freedoms of individuals.The Malagasy constituents have since 1992 established that the development of Madagascar and the flourishing of its people will require the establishment of a rule of law. It is clear that currently underdevelopment has taken hold and extreme poverty seems to be gaining ground. Therefore, we legitimately wonder about the situation of the rule of law in Madagascar.An extremely large and complex concept, the rule of law will be approached primarily from a financial perspective. Theoretical construction, the financial rule of law is an object of study allowing simultaneous reflection on the hierarchy of norms, the exercise of power and the judicial system in the field of public finance. The research carried out in the light of the doctrine shows that there is a real legal will to establish the rule of law in Madagascar, but it would obviously meet with political resistance. This observation is based on an in-depth analysis of the hierarchy of Malagasy financial standards. Madagascar's normative engineering does not differ from mimicry with the French system already adopted by other French-speaking African states. However, there is a certain normative disorder which leads to an institutional imbalance. This is characterized mainly by a preponderance of the executive and a withdrawal of Parliament from the exercise of financial power.
