| Περιγραφή: | This contribution focuses on the threats weighing on the Human Rights Act 1998 under the Conservative government of Boris Johnson, in light of previous criticisms coming from political actors and growing questioning from the judiciary. The analysis defends the position, supported by the Independent Review on the Human Rights Act, that the criticisms raised by the Conservative government are mostly unfounded and that proposals to reform the Human Rights Act would weaken the protection of Human Rights on the domestic level, while increasing the risk of divergence with the European Court of Human Rights. ; Cet article se penche sur les menaces qui pesaient sur l’avenir du Human Rights Act 1998 sous le gouvernement conservateur de Boris Johnson, au vu des critiques formulées depuis plusieurs années par les acteurs du monde politique, et des questionnements gagnant également le monde judiciaire. Cette analyse défend la thèse, appuyée par la commission indépendante chargée d’examiner le Human Rights Act, que les critiques soulevées par le gouvernement conservateur de Boris Johnson sont largement infondées et que les propositions de réforme du Human Rights Act affaibliraient la protection des droits humains au niveau national, tout en augmentant le risque de divergence avec la Cour Européenne des Droits de l’Homme. |
