Περιγραφή: De manière inédite, la Cour européenne des droits de l’homme s’est penchée sur l’obligation de l’État de lutter contre les ingérences étrangères dans le cadre des élections. Bien que la Cour conclue à la non-violation de l’article 3 du Premier Protocole additionnel, l’arrêt Bradshaw et autres c. Royaume-Uni est l’occasion de reconnaître l’obligation positive de l’État de réagir face à des allégations crédibles d’ingérences hostiles risquant de porter atteinte au droit de l’électorat à l’organisation d’élections libres. Toutefois, après cet arrêt, un certain nombre de questions restent encore en suspens. ; For the first time, the European Court of Human Rights examined states’ obligation to fight foreign interference in their elections. Although the Court found n° violation of Article 3 of the first Additional Protocol, the judgment in the case of Bradshaw and Others v. the United Kingdom established the positive obligation for states to respond to credible allegations of hostile interference that threaten the electorate’s right to free elections. However, after this ruling, several questions remain unanswered.
