| Description: | The article is devoted to the study of modern aspects of legal support for consumer rights protection. The article emphasizes that in the context of globalization, digitalization of the economy and the expansion of the consumer issue, the effectiveness of legal support for consumer rights protection in the market is of particular importance. The article examines the current regulatory framework for consumer protection. It is noted that international agreements, such as the Association Agreement between Ukraine and the EU, contribute to the harmonization of national legislation with European standards, ensuring a common approach to solving consumer problems and increasing the transparency of the control system. A legal analysis of the system of state control in the field of consumer rights protection is conducted. The article emphasizes that the current Law of Ukraine «On Consumer Rights Protection» defines in detail the legal status of the consumer, and also establishes a mechanism for protecting his rights. Today, the implementation of state policy in the field of consumer protection is ensured by the State Service of Ukraine for Food Safety and Consumer Protection, the Antimonopoly Committee of Ukraine, the Ministry of Economy of Ukraine, local governments, and law enforcement agencies. The conclusions emphasize that in modern conditions, the existing legislative framework for regulating relations in the field of consumer protection is a key element in ensuring the effectiveness of the implementation of state policy. State control in the field of consumer protection is an important mechanism for ensuring compliance with the legislation regulating the relationship between consumers and business entities. It involves systematic monitoring of the activities of enterprises, verification of the compliance of their products and services with the requirements of regulatory legal acts, prevention and elimination of violations of consumer rights, as well as ensuring compensation for losses in case of violations. Control is aimed at preventing fraud, scams, and unfair competition, creating safe conditions for the consumption of goods and services, and maintaining citizens’ trust in government agencies. Стаття присвячена дослідженню сучасних аспектів правового забезпечення захисту прав споживачів. В статті наголошується на тому, що в контексті глобалізації, цифровізації економіки та розширення споживчого ринку питання ефективності правового забезпечення в сфері захисту прав споживачів набуває особливого значення. В статті досліджено чинне нормативно-правове регулювання захисту прав споживачів. Зазначено, що міжнародні угоди, такі як Угода про асоціацію між Україною та ЄС, сприяють гармонізації національного законодавства з європейськими стандартами, забезпечуючи спільний підхід до вирішення проблем споживачів і підвищення прозорості системи контролю. Проведено правовий аналіз системи державного контролю в сфері захисту прав споживачів. В статті наголошується на тому, що чинним Законом України «Про захист прав споживачів» докладно визначено правовий статус споживача, а також встановлено механізм захисту його прав. На сьогодні реалізація державної політики в сфері захисту прав споживачів забезпечується Державною службою України з питань безпечності харчових продуктів та захисту споживачів, Антимонопольним комітетом України, Міністерством економіки України, органами місцевого самоврядування та правоохоронними органами. У висновках наголошується на тому, що в сучасних умовах наявна законодавча база щодо регулювання відносин в сфері захисту прав споживачів є ключовим елементом у забезпеченні ефективності реалізації державної політики. Державний контроль у сфері захисту прав споживачів є важливим механізмом забезпечення дотримання законодавства, яке регулює взаємовідносини між споживачами та суб’єктами господарювання. Він передбачає систематичний моніторинг діяльності підприємств, перевірку відповідності їхньої продукції та послуг вимогам нормативно-правових актів, попередження та усунення порушень прав споживачів, а також забезпечення компенсації збитків у разі порушень. Контроль спрямований на запобігання обману, шахрайства та недобросовісної конкуренції, створення безпечних умов для споживання товарів і послуг, а також на підтримку довіри громадян до державних органів. |
