| Description: | The article is devoted to a comprehensive study of administrative and legal mechanisms for controlling and supervising the activities of the media in the interests of ensuring Ukraine’s national security in the context of ongoing information aggression. The paper outlines the limits of permissible restrictions on freedom of speech, as defined in Article 34 of the Constitution of Ukraine, and analyzes the legal instruments used by the state to ensure a balance between the protection of information security and the guarantees of democratic rights. The key areas of control and supervision activities are highlighted: control over compliance with the general provisions and requirements of legislation that define the permissible limits of information dissemination by media entities; supervision of compliance with the conditions of licensing activities of media entities that, in accordance with the law, require special permits (licenses) to conduct their activities; control over compliance with the requirements of legislation on the dissemination (distribution) of advertising in the media, aimed at minimising the risks of spreading unreliable information, manipulating public consciousness, ensuring the transparency and reliability of advertising content, and preventing hidden influence on Ukraine’s information space; monitoring compliance with the requirements for the accreditation of journalists, which ensures them proper access to information events and protects the state from unauthorized interference in information processes and potential threats associated with the activities of non-accredited persons. A number of systemic problems in the National Council’s activities have been identified: insufficient technical and human resources capacity of the regulator; lack of full control over the activities of online platforms; delays in court proceedings when imposing sanctions; the phenomenon of the «revival» of banned media. Areas for improvement of the state control and supervision system have been proposed: increasing the resource capacity of the National Council of Ukraine on Television and Radio Broadcasting; introducing automated monitoring systems using artificial intelligence; improving accreditation procedures; strengthening interagency and international cooperation; modernizing the regulatory framework. The results of the study can be used to develop effective state policy in the field of information security, combining the protection of national interests and compliance with freedom of speech standards. Стаття присвячена комплексному дослідженню адміністративно-правових механізмів контролю та нагляду за діяльністю засобів масової інформації в інтересах забезпечення національної безпеки України в умовах триваючої інформаційної агресії. У роботі окреслюються межі допустимого обмеження свободи слова, визначені ст. 34 Конституції України, та аналізуються правові інструменти, за допомогою яких держава забезпечує баланс між захистом інформаційної безпеки та гарантіями демократичних прав. Виокремлено ключові напрями контрольно-наглядової діяльності: контроль за дотриманням загальних положень і вимог законодавства, що визначають допустимі межі поширення інформації суб’єктами у сфері медіа; нагляд за виконанням умов ліцензійної діяльності суб’єктів сфери медіа, які відповідно до законодавства потребують отримання спеціальних дозволів (ліцензій) на ведення своєї діяльності; контроль за виконанням вимог законодавства щодо поширення (розповсюдження) реклами у ЗМІ, покликаний мінімізувати ризики поширення недостовірної інформації, маніпуляцій суспільною свідомістю, забезпечити прозорість і достовірність рекламного контенту, а також не допустити прихованого впливу на інформаційний простір України; контроль за виконанням вимог щодо акредитації журналістів, що забезпечує їм належний доступ до інформаційних подій, а також захищає державу від несанкціонованого втручання в інформаційні процеси та потенційних загроз, пов’язаних із діяльністю неакредитованих осіб. Виявлено низку системних проблем діяльності Національної ради: недостатню технічну та кадрову спроможність регулятора; відсутність повного контролю за діяльністю онлайн-платформ; затягування судових процедур при застосуванні санкцій; явище «відродження» заборонених медіа. Запропоновано напрями вдосконалення системи державного контролю та нагляду: підвищення ресурсного потенціалу Національної ради України з питань телебачення і радіомовлення; впровадження автоматизованих систем моніторингу з використанням штучного інтелекту; удосконалення акредитаційних процедур; посилення міжвідомчої та міжнародної співпраці; модернізація нормативно-правової бази. Результати дослідження можуть бути використані для розробки ефективної державної політики у сфері інформаційної безпеки, що поєднує захист національних інтересів і дотримання стандартів свободи слова. |
