У статті визначено поняття процедурних строків в сфері державних соціальних допомог, здійснено їх класифікацію за різними критеріями. Запропоновано кілька власних класифікацій залежно від сфери правового регулювання, характеру регламентуючої норми, мети процедурних юридичних дій та структури нормативної моделі процедури забезпечення державною соціальною допомогою. The article deals with and defines procedural terms in the branch of state social assistance in the light of academic literature and current regulations and standards, their classification has been made. Procedural terms in the branch of state social assistance have been suggested to consider any time periods established in a regulatory act, they are terminable or limited by occurrence of certain events, restrict to implementation of procedural legal actions provided by a procedural normative model of state social assistance. The classification of procedural terms has been made according to the criteria worked out in other law branches: according to the normative consolidation mode, according to the degree of certainty and according to the acceptance. Based on the abovementioned criteria the distinction between certain types has been found out taking into consideration particular characteristics of legal regulation for state social assistance. More types of the classification have been suggested in the article such as according to the legal regulation branch, according to the type of regulatory rules, according to the objective of procedural actions and according to the structure of a procedural normative model of state social assistance. The research defined that various criteria can be applied for the classification of procedural terms in the branch of state social assistance. Meanwhile for the purposes of the research and law enforcement the most appropriate classification is the classification according to the structure of a procedural normative model of state social assistance. According to this criterion the following types of procedural terms can be divided into duration periods for implementation of main procedural legal actions, duration periods for implementation of additional procedural legal actions, duration periods for implementation of concurrent procedural legal actions. |
