| Περιγραφή: | The article is devoted to the analysis of legal consequences of adoption ’s dissolution, which is being considered in the light of the equivalence of relative connections between adopted and adopters and they are investigated from the point of view of child ’s interests. The necessity of guardianship authority’s choice of the ways of child’s placement of whose dissolution of adoption is made, is grounded, before judicial stage of case ’s preparation and strengthening an active role of the court, doing it s cases consideration. Criterions, that can be used by court to decide whether to retain or change the child’s name as a basic element of his(her) individuality are offered. Approaches taking place in law of the Russian Federation as well as in law of modern European countries, concerning definition “child’s interests” are undergone by comparative analysis and a conclusion of the difference of their supporting is drawn: in European countries it is a synonym the definition “welfare, wellbeing”, it is changed in the Russian Federation on by “neediness”. It is argued that the dissolution of adoption must be absolute obligation of the former adopters on their former adopted child ’s maintenance on analogy with the obligations of the parents when they are terminated their parental rights not owing to circumstances of adoption ’s dissolution. |
