Description: This article focuses on the legal procedure for foreclosure on mortgage property. Particular attention is paid to the analysis of contractual and legal mortgages, as well as the order of foreclosure on mortgaged property in such cases. The author investigates the specific features of the origin of mortgages, both by virtue of the law, and by virtue of the contract. In the process of research, the features of the civil legal procedure for foreclosure on mortgage property are disclosed. It is noted that foreclosure is allowed even if the mortgage property is the only dwelling of the debtor. In this regard, the author examines in detail the procedure for disposing of the debtor’s single housing.
Настоящая статья посвящена правовой процедуре обращения взыскания на ипотечное имущество. Особое внимание уделяется анализу договорной и законной ипотеки, а также порядку обращения взыскания на заложенное имущество в таких случаях. Автор исследует специфические особенности возникновения ипотеки как в силу закона, так и в силу договора. В процессе исследования раскрываются особенности гражданско-правовой процедуры обращения взыскания на ипотечное имущество. Отмечается, что обращение взыскания допускается даже в том случае, если ипотечное имущество является единственным жильем должника. В этой связи автор детально рассматривает процедуру лишения должника единственного жилья.
