Description: The article examines the main provisions of the new model of the Brazilian bilateral investment agreement, emphasizes its importance for ensuring the protection of the rights of a foreign investor and the construction of a favorable investment climate. The author pays special attention to the institutional structure of the alternative mechanism for regulating investment legal relations laid down in the new treaty model, and also highlights some aspects of the peculiarities of the legal traditions of Latin American countries in terms of the legal regulation of foreign investment.
В статье исследуются основные положения новой модели двустороннего инвестиционного договора Бразилии, подчеркивается его значение для обеспечения защиты прав иностранного инвестора и конструирования благоприятного инвестиционного климата. Основное внимание автор уделяет институциональной структуре альтернативного механизма регулирования инвестиционных правоотношений, заложенного в новой модели договора, а также освещает некоторые аспекты особенностей правовых традиций стран Латинской Америки в части правового регулирования иностранных инвестиций.
