| Description: | The provisions of the legislation on the inheritance contract appeared in Russia on June 1, 2019. One of the main goals of this novel was to expand the possibilities of the testator in expressing testamentary dispositions by introducing rules on the inheritance contract into the Civil Code of the Russian Federation. Considering that the regulatory framework of the inheritance agreement is still in the process of formation, and law enforcement practice is still not well established, a large number of its aspects are the subject of discussion in the scientific literature. This article is devoted to the study of problematic issues of legal regulation of inheritance law. Положения законодательства о наследственном договоре появились в России с 1 июня 2019 года. Одной из главных целей данной новеллы было расширение возможностей наследодателя при выражении им завещательных распоряжений за счет введения в Гражданский кодекс Российской Федерации правил о наследственном договоре. Учитывая, что нормативная база наследственного договора находится всё еще в стадии формирования, а правоприменительная практика всё еще не устоялась, большой ряд его аспектов является предметом дискуссий в научной литературе. Данная статья посвящена исследованию проблемных вопросов правового регулирования наследственного права. |
