Статья посвящена исследованию понятий кооперации и кооперативов с точки зрения современного российского права. Кооперация рассматривается как содружество с целью удовлетворения социальных, экономических и других потребностей. В первую очередь речь идёт о правовом регулировании вопросов, касающихся кооперативов и правового статуса их членов. Рассмотрены проблемы, возникающие при создании и ведении кооперативов; определяются возможные пути их решения, в том числе через кодификацию и обновление законодательства. Обозначены существующие виды кооперативов, законные права и обязанности членов кооперативов. The article is devoted to the study of the concept of cooperation and cooperatives from the point of view of modern Russian law. Cooperation is seen as a pool of labor and means for joint initiative in order to meet social, economic and other needs of its members. The authors examine different types of cooperatives, the legal regulation of issues related to cooperatives, problems arising when starting and running a cooperative. The paper discusses the legal status of cooperative members, their legal rights and obligations. Some solutions are provided, including codification and updating of legislation. |
