| Description: | Background: in accordance with Art. 71 of the Constitution of the Russian Federation, scientific and technological development falls under the jurisdiction of the Russian Federation. At the same time, Article 72 of the Constitution of the Russian Federation attributes the issues of science in general to the joint powers of the Russian Federation and its subjects. The Federal Law “On Science and State Science and Technology Policy” attributes the main range of powers in this area to the federal bodies of state power. Accordingly, there is a question of specifying the powers of state authorities of the subjects of the Russian Federation in the sphere of defining and implementing the directions of scientific and technological development, in particular of the subjects of the federation. Objective — to consider the components of scientific and technological development of Russia, the powers of public authorities in this area and their legal consolidation, taking into account the mechanism of delimitation of subjects of jurisdiction and powers between the public authorities of the Russian Federation and the public authorities of the subjects of the Russian Federation. Methodology: a set of methods of scientific knowledge, general scientific and private scientific methods (historical, comparative legal, systemic). Conclusions and generalizations were formulated on the basis of the logical method of research. Results: the concept, structural components and constitutional-legal regulation of scientific and technological development of Russia were analyzed taking into account the constitutional model of delimitation of subjects of jurisdiction and powers between the state authorities of the Russian Federation and state authorities of the subjects of the Russian Federation in the considered sphere of public relations. Conclusions: for the purpose of perspective scientific and technological development of the subjects of the Russian Federation, which is the basis of state building of Russia as a whole, the proposals on the necessity of adoption of a new federal law “On Science and State Scientific and Technological Policy of the Russian Federation” and concretization at its level of powers of state authorities of the subjects of the Russian Federation in the sphere of scientific and technological development, aimed at fixing the types of subjects of scientific-technological and research activities and their mutual interaction with state authorities of the Russian Federation and civil society institutions, as well as ensuring their material and financial support and the effectiveness of their activities, have been formulated. Введение: в соответствии со ст. 71 Конституции РФ научно-технологическое развитие находится в ведении Российской Федерации. Вместе с тем в ст. 72 вопросы науки в целом относятся к совместным полномочиям Российской Федерации и ее субъектов. В Федеральном законе «О науке и государственной научно-технической политике» основной круг полномочий в рассматриваемой сфере закреплен за федеральными органами государственной власти. Соответственно, встает вопрос о конкретизации полномочий органов государственной власти субъектов РФ в сфере определения и реализации направлений научно-технологического развития, в частности субъектов федерации. Цель — рассмотреть компоненты научно-технологического развития России, полномочий органов государственной власти в данной сфере и их правовое закрепление с учетом механизма разграничения предметов ведения и полномочий между органами государственной власти РФ и органами государственной власти субъектов РФ. Методологическая основа: совокупность методов научного познания, общенаучные и частнонаучные методы (исторический, сравнительно-правовой, системный). Выводы и обобщения формулировались на основе логического метода исследования. Результаты: проведен анализ понятия, структурных компонентов и конституционно-правового регулирования научно-технологического развития России с учетом конституционной модели разграничения предметов ведения и полномочий между органами государственной власти РФ и органами государственной власти субъектов РФ в рассматриваемой сфере общественных отношений. Выводы: с целью перспективного научно-технологического развития субъектов РФ, являющегося основой государственного строительства России в целом, сформулированы предложения по необходимости принятия нового федерального закона «О науке и государственной научно-технологической политике Российской Федерации» и конкретизации на его уровне полномочий органов государственной власти субъектов РФ в сфере научно-технологического развития, направленных на закрепление видов субъектов научно-технологической и научно-исследовательской деятельности и их взаимодействия между собой, с органами государственной власти РФ и институтами гражданского общества, а также на обеспечение их материально-финансовой поддержки и результативности деятельности. |
