Description: Рассматриваются некоторые вопросы ограничения государственной власти в области правового регулирования охраны и использования земель сельскохозяйственного назначения. Спрогнозирован основной сценарий состояния земель сельскохозяйственного назначения России в связи с изменением климата, выпадением кислотных осадков, бессистемным применением в сельском хозяйстве ядохимикатов. Утверждается, что отрицательные воздействия на земли сельхозназначения негативно отразятся на состоянии здоровья человека, а рост заболеваемости вызовет волну недовольства населения, в ответ на которое государство посредством ужесточения земельного и иного смежного с ним законодательства предпримет попытку агрессивного ограничения прав и свобод сельскохозяйственных товаропроизводителей. Предпринимается попытка ответить на непростые вопросы современности: как в этой связи гармонизировать земельно-правовые интересы всех участников земельных отношений и государства как и в каких земельно-правовых ситуациях ограничить вседозволенность и даже агрессивность государства в организационно-правовом регулировании охраны и рационального использования земель сельскохозяйственного назначения Дается определение понятия ограничение правомочий государственной власти в области охраны и рационального использования земель сельскохозяйственного назначения . The article deals with some issues of restriction of state power in the field of legal regulation of protection and use of agricultural land. The main scenario of the state of agricultural lands in Russia in connection with global climate warming, acid precipitation, haphazard use of pesticides in agriculture is predicted. It is shown how these negative changes will have a negative impact on human health. Since the increase in morbidity will cause a wave of discontent of the population, as a reaction to this, the state, - according to the author, - by tightening the land and other related legislation, will attempt to aggressively restrict the rights and freedoms of agricultural producers. An attempt to answer the difficult questions of our time: how in this context to harmonize land legislation and the interests of all participants of land relations with state interests as in any land and legal situations to limit the permissiveness and even aggressiveness of the state in legal regulation of protection and sustainable use of agricultural land The definition of the concept restriction of the powers of state power in the field of protection and rational use of agricultural land is given.
