| Description: | Статья посвящена рассмотрению актуальной проблемы законодательной регламентации понятий длящегося и продолжаемого преступлений. На основе анализа уголовного законодательства России и отдельных зарубежных стран, научных трудов российских ученых и актуальной судебной практики автор сформулировал конкретные выводы и предложения, в своей совокупности образующие новое знание относительно целесообразности закрепления в Общей части Уголовного кодекса Российской Федерации понятийного аппарата, включающего, в частности, определения длящегося и продолжаемого преступлений, а также содержания таких определений. This article is devoted to the consideration of the actual problem of legislative regulation of the concept of continuing and continuing crimes. Based on the analysis of the criminal legislation of Russia and certain foreign countries, scientific works of Russian scientists and current judicial practice, the author formulated specific conclusions and proposals, collectively forming new knowledge about the expediency of fixing the conceptual apparatus in the General Part of the Criminal Code of the Russian Federation, including, in particular, definitions of ongoing and ongoing crimes, as well as the content such definitions. |
