| Description: | Статья посвящена изучению вопросов, связанных с предоставлением правовой охраны результатам генетических исследований, определением надлежащей модели защиты биотехнологических решений, а также анализу условий охраноспособности таких объектов и выработке собственных концепций обеспечения защиты правообладателей. С учетом активности внедрения инновационных биотехнологических решений актуализируется проблема правопонимания рассматриваемых объектов, разумность и пределы их использования. Авторами проводится оценка преимуществ и недостатков патентного режима охраны результатов геномных исследований, а также изучаются перспективы применения данной модели правовой защиты биотехнологий в Российской Федерации. The article is devoted to the study of issues related to the provision of legal protection to the results of genetic research, the definition of an appropriate model for the protection of biotechnological solutions, the analysis of the conditions for the protection of such objects, as well as the development of their own concepts to ensure the protection of copyright holders. Taking into account the active introduction of innovative biotechnological solutions, the legal understanding of the objects under consideration, the reasonableness and limits of their use are updated. The authors assess the advantages and disadvantages of the patent regime for the protection of genomic research results, and also consider the prospects for the application of this model of legal protection of biotechnologies in the Russian Federation. |
