Περιγραφή: A preventive measure in the form of detention is being considered, which is often chosen on the territory of a foreign state before the Russian Federation sends a request to a foreign state for the extradition of a person. In this regard, the question arises about the offset of the term of such content. The procedure for choosing a preventive measure in the form of detention during extradition is considered. The analysis of judicial practice is given in order to identify the most common errors when taking into account the period of detention in order to ensure the correct and uniform application of criminal procedure legislation by courts when considering a problematic issue.
Рассматривается мера пресечения в виде заключения под стражу, которая зачастую избирается на территории иностранного государства до того, как Российская Федерация направит запрос иностранному государству о выдаче лица. В связи с этим, возникает вопрос о зачете срока такого содержания. Рассмотрена процедура избрания меры пресечения в виде заключения под стражу при экстрадиции. Приводится анализ судебной практики с целью выявления наиболее часто встречающихся ошибок при учете срока содержания под стражей для обеспечения правильного и единообразного применения судами уголовно-процессуального законодательства при рассмотрении проблемного вопроса.
