Περιγραφή: In the process of conducting a preliminary investigation, the investigator is obliged not only to pursue the goals of the investigation, but also to consider the means of achieving them. If the principles of legality and morality are not observed, evidence obtained during the investigation may be considered inadmissible in court, and the authority of the investigator's profession will be damaged. The currently existing codes of professional ethics for employees of various investigative agencies regulate the general approach to their official and off-duty behavior and do not fully regulate situations of moral choice in the process of carrying out an investigation. Therefore, it is necessary to review the provisions of the code of ethics and official conduct of federal civil servants performing the functions of preliminary investigation of crimes and criminal prosecution at the pre-trial stage of legal proceedings.
В процессе проведения предварительного расследования следователь обязан не только преследовать цели расследования, но и считаться со средствами их достижения. При несоблюдении принципов законности и нравственности, доказательства, полученные в ходе расследования, могут быть признанными недопустимыми в суде, а авторитету профессии следователя будет нанесен ущерб. Существующие в настоящее время Кодексы профессиональной этики работников различных следственных органов регламентируют общий подход к их служебному и внеслужебному поведению и не в полной мере регулируют ситуации нравственного выбора в процессе осуществления расследования. Поэтому следует произвести пересмотр положений Кодекса этики и служебного поведения федеральных государственных служащих, осуществляющих функции предварительного расследования преступлений и уголовного преследования на досудебной стадии судопроизводства.
