| Περιγραφή: | In the procedure for declaring a person on the international wanted list for the purpose of arrest and extradition for criminal prosecution or execution of a sentence, such categories as grounds and conditions invariably appear. Meanwhile, in the special literature devoted to the issues of international search, there is no sufficient clarity in the understanding of these categories, different circumstances are named as the grounds and conditions for declaring them on the international wanted list, conditions are often not delimited from the grounds, sometimes they are simply mixed with each other. In the article, on the basis of the conducted research, the concept of the grounds and conditions for declaring a person on the international wanted list is given, their system is given, and the inclusion of certain circumstances in it is argued. On the basis of the proposed system, the specific content of the grounds and conditions for declaring it on the international wanted list is disclosed, taking into account the regulatory legal acts in force in this area. Рассматривается процедура объявления в международный розыск лица в целях ареста и выдачи для уголовного преследования или исполнения приговора где неизменно фигурируют такие категории как основания и условия. Между тем, в специальной литературе, посвященной вопросам международного розыска, отсутствует достаточная ясность в понимании указанных категорий, в качестве оснований и условий объявления в международный розыск называются разные обстоятельства, часто условия не отграничиваются от оснований, порой они просто смешиваются друг с другом. На основании проведенного исследования дается понятие оснований и условий объявления лица в международный розыск, приводится их система, аргументируется включение в нее тех или иных обстоятельств. На основе предложенной системы раскрывается конкретное содержание оснований и условий объявления в международный розыск с учетом действующих в этой сфере нормативно-правовых актов. |
