| Description: | В статье рассмотрена проблема совершенствования систематизации правовых норм. Решается ряд вопросов, объединенных идеей необходимости сохранения и развития отраслевой модели как основы для упорядочения нормативного материала. Дана оценка роли правовых принципов в процессе организации правовых норм, в том числе для обособления отраслей как самостоятельных элементов системы права. Сделан вывод о практическом значении отраслевой модели, сформированной по принципу предметного единства регулируемых общественных отношений. Такое единство обеспечивается на основе правовых принципов вследствие их первичности по отношению к предмету правового регулирования. Доказана необходимость их признания в качестве полноценного и ведущего фактора образования отраслей права. Метод правового регулирования, по мнению авторов статьи, предназначен для реализации принципов применительно к тем отношениям, которые определены как предмет соответствующей отрасли. The article considers the problem of improving the systematization of legal norms. A number of issues are being resolved, united by the idea of the need to preserve and develop the industry model as the basis for streamlining the regulatory material. An assessment is given of the role of legal principles in the process of organizing legal norms, including for separating industries as independent elements of the legal system. The conclusion is made about the practical significance of the sectoral model, formed on the principle of subject unity of regulated social relations. Such unity is provided on the basis of legal principles due to their primacy in relation to the subject of legal regulation. The necessity of their recognition as a full-fledged and leading factor in the formation of branches of law is proved. The method of legal regulation, according to the authors of the article, is intended to implement the principles in relation to those relations that are defined as the subject of the relevant industry. |
