Description: the relevance of the topic of the article is determined by the presence of a complex of unresolved problems on the creation of doctrines and theories in forensic science, the need to analyze and determine rational ways to solve them. The purpose of the article is to create theoretical provisions aimed at improving the process of forming forensic doctrines and theories. The research methodology was made up of a dialectical method, a complex of general scientific and special methods of scientific cognition (analysis, synthesis, comparison, modeling, etc.), including a systematic approach to the study of the problem under consideration. The issues of ambiguous interpretation of the essential content of forensic theories (teachings) in connection with the establishment of their place in the system of forensic science are identified and considered. Explanations are given on the structural construction of theories (teachings), the methodological foundations of theories (teachings) are clarified through the prism of researching the methodology of forensic science.
актуальность темы статьи определяется наличием комплекса неразрешенных проблем по вопросу создания учений и теорий в криминалистике, необходимостью анализа и определения рациональных путей их решения. Цель статьи заключается в создании теоретических положений, направленных на совершенствование процесса формирования криминалистических учений и теорий. Методологию исследования составили диалектический метод, комплекс общенаучных и специальных методов научного познания (анализ, синтез, сравнение, моделирование и др.), в том числе системный подход. Обозначены и рассмотрены вопросы неоднозначного толкования сущностного содержания криминалистических теорий (учений) во взаимосвязи с установлением их места в системе криминалистики. Даны пояснения по структурному построению теорий (учений), уточнены методологические основы теорий (учений) сквозь призму исследования методологии криминалистики.
