Description: The article is devoted to the grounds of termination of criminal case and criminal prosecution in cases where it is impossible to bring a person to criminal responsibility. In the article, the author expresses his opinion on some provisions of the ruling of the Constitutional Court of 15.06.2021 № 28-P, which he does not fully agree with. The author’s own view is based on an analysis of the relevant criminal law and criminal procedure institutions and the positions of other scholars on the issues under consideration. Solutions to the problems identified are proposed.
Статья посвящена основаниям прекращения уголовного дела и уголовного преследования в случаях, когда привлечение лица к уголовной ответственности невозможно, с учетом их правовой природы. Автор высказывает свое мнение по поводу некоторых положений постановления Конституционного Суда РФ от 15 июня 2021 г. № 28-П, с которыми он не согласен в полной мере. Точка зрения автора основывается на анализе соответствующих уголовно-правовых и уголовно-процессуальных институтов, позиций других ученых по рассматриваемым вопросам. Предлагаются пути решения выявленных проблем.
