Description: В представленной работе рассматриваются актуальные проблемы организации и производства некоторых следственных действий, возникающие у сотрудников органов предварительного расследования при собирании доказательств по уголовному делу. Авторами предлагается дополнить перечень следственных действий, в результате которых могут быть получены показания подозреваемых, обвиняемых, свидетелей и потерпевших, очной ставкой, проверкой показаний на месте и предъявлением для опознания. На основе анализа нормативных правовых актов, следственной и судебной практики показаны типичные ошибки, допускаемые следователями в связи с применением норм права, определяющих порядок производства осмотра места происшествия, проверки показаний на месте и др. Особое внимание уделяется проблеме изъятия электронных носителей информации для решения вопроса об их использовании в качестве доказательств по уголовным делам. Акцентируется внимание на недостатках законодательной регламентации условий изъятия электронных носителей информации в рамках расследования по уголовному делу.
The article considers the current problems of the organization and production of some investigative actions faced by the preliminary investigation bodies in gathering evidence in a criminal case. The authors propose to add to the list of investigative actions, as a result of which testimonies of suspects, accused persons, witnesses and victims can be obtained, such as, confrontation, onsite testimony and presentation for identification. Typical errors of investigating officers defining the procedure for conducting a crime scene search checking evidence at the scene and others are shown the basis of the analysis of regulatory legal acts investigative and judicial practice. The authors also paid particular attention to the seizure of electronic storage media when they are used as evidence in criminal cases. The attention is focused on the shortcomings of the legislative regulation of the conditions of seizure of electronic storage media in a criminal investigation.
