| Description: | The article is devoted to the problems of the court's assessment of the expert opinion as a means of proof. The assessment of the expert's opinion for its relevance, admissibility and reliability allows the court to justify the decision most fully and competently. The author draws attention to the particular complexity of the assessment of the expert opinion on the reliability and advocates strengthening the role of the review of the expert opinion in the process of its evaluation by the court Статья посвящена проблемам оценки судом заключения эксперта как средства доказывания. Оценка заключения эксперта на предмет ее относимости, допустимости и достоверности позволяет суду наиболее полно и компетентно обосновать принятое решение. Автор обращает внимание на особую сложность оценки экспертного заключения на достоверность и выступает за усиление роли рецензии на заключение эксперта в процессе ее оценки судом. |
