Περιγραφή: Considered the issues related to the institution of property rights, the reasons of their occurrence, analysed the peculiarities of civil legal relations arising from the discovery of the treasure. It is concluded that there is no clear concept of «cultural value» in the legislation, the legal regime of things belonging to the category of treasure, and representing cultural value, after the discovery of the treasure is not defined. In this regard, concluded that the uncertainty of civil protection of the rights of persons involved in these legal relations.
Рассмотрены вопросы, относящиеся к институту вещных прав, основания их возникновения, проанализированы особенности гражданских правоотношений, возникающих при обнаружении клада. Сделан вывод о об отсутствии в законодательстве четкого понятия «культурная ценность», а также не определен правовой режим вещей, относящихся к категории «клад», и представляющих культурную ценность, после обнаружения клада. В связи с этим делается вывод о неопределенности гражданскоправовой защиты прав лиц, участвующих в этих правоотношениях.
