Περιγραφή: The article systematically analyzes the reasons for the termination of the escrow contract, first of all, from the point of view of their conformity to the essence and the appointment of the escrow obligation, as well as the balanced provision of the interests of the parties to the agreement; among other things, focuses on the asymmetric structuring of rights and obligations under the escrow obligation and identifies the problems of participation in escrow transactions by notaries (as escrow agents).
Системно анализируются основания прекращения договора эскроу, прежде всего с точки зрения их соответствия сущности и назначению обязательства условного депонирования, а также сбалансированного обеспечения интересов сторон соглашения; среди прочего акцентируется внимание на несимметричном структурировании прав и обязанностей в рамках обязательства условного депонирования и выявляются проблемы участия в сделках эскроу нотариусов (в качестве эскроу-агентов).
